This Waiver of Liability is granted in favor of Mount Vernon Nazarene University, 800 Martinsburg Road, Mount Vernon, Ohio, its trustees, directors, employees, and agents.

Statement of Event: This Waiver of Liability is for the Mount Vernon Nazarene University’s Appalachian Reach Out Alumni Ministry Trip August 25-28, 2022.
This Waiver of Liability applies to all events in which the participant/observer may participate or watch.

AT ALL TIMES, THE PARTICIPANT/OBSERVER SHOULD NOT PARTICIPATE OR OBSERVE ANY EVENT OR ACTIVITY WHICH THEY PERCEIVE THERE TO BE AN IMMEDIATE THREAT TO THEIR SAFETY. THEY SHOULD ALERT THE EVENT AUTHORITIES OF ANY ACTIVITY THEY FEEL IS UNSAFE OR A THREAT TO OTHERS. IF THEY ARE UNABLE TO COMPLETE THE ACTIVITY, THEY SHOULD ALERT THOSE SUPERVISING THE EVENT.

1. Acknowledgment of RisksThese risk include, but are not limited to, serious bodily injury, psychological or emotional injury, personal injury, illness, death, or property damage, all of which may be caused by the negligence of Mount Vernon Nazarene employees, volunteers, students, or agents.

2. Assumption of Risks. The activities may require physical exertion, use of mechanical equipment with unpredictable results, and exposure to hazardous conditions. Participant/observer expressly and specifically assumes the risk of serious injury, bodily harm, or harm to personal property in the activities.

3. Release and Waiver. Participant/observer freely, voluntarily, and without duress, elects to participate in spite of the associated risks, and by signing this Waiver of Liability, knowingly and voluntary assumes all responsibility for participation and/or observation. Participant/observer does hereby release and forever discharge and hold harmless Mount Vernon Nazarene University, its trustees, directors, employees, and agents from any and all liability, claims, and demands of whatever kind or nature, either in law or equity, that arise or may hereinafter arise from Participant/observer’s activities at Breakaway on the properties owned by Mount Vernon Nazarene University or Appalachian Reach Out. Participant/observer understands this Waiver of Liability releases Mount Vernon Nazarene University from any liability or claim the participant/observer may have against Mount Vernon Nazarene University and/or it trustees, directors, employees, and agents with respect to claims which may arise from the activities including all liability for injury, illness, death, or property damage resulting from the activities.

4. Other. Participant/observer expressly agrees that this Release is intended to be as inclusive as permitted by the laws of the State of Ohio, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Ohio. Participant/observer also agrees that in the event any clause or provision of this Waiver of Liability or Release shall be held invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Waiver of Liability or Release, which shall continue to be enforceable.
